To meet the legal requirements for marriage in Australia, a man and woman must:

  • not be married to someone else
  • not be marrying a parent, grandparent, child, grandchild, brother or sister
  • be at least eighteen years old, unless a court has approved a marriage where one party is aged between sixteen and eighteen years old
  • understand what marriage means and freely consent to becoming husband and wife
  • use specific words during the ceremony
  • give written notice of their intention to marry to their authorised celebrant.

 

Legal Requirements for Marriage in Australia

Age requirements

To be married in Australia you must be over the age of 18 years old. If under 18, you can apply to the Courts for permission of a Judge to be married.

Notice of Intended Marriage (NOIM) (Form 13)

NOIM is required to be completed and lodged with your celebrant at least one month and one day prior to the wedding date and no more than eighteen months prior to the wedding date. If you are under some exceptional circumstances that you need to waive that waiting period, this can be done by applying for the order from the Court or the Registry.

You Identification Documents

You need to provide three photo IDs (passports, driver’s license, photo cards etc) and if you have married before, you need to provide your divorce certificates (death certificate if applicable)

If you are born in Australia, you need to provide your birth certificate, however, if you are holding an overseas passport, no birth certificate needed.

Overseas Couple

My fiancé is at an overseas country, can we get married in Australia?
Of course, you can.
If one of you is in Australia, you can complete and lodge the Form 13 with me and we can start our preparation straight away. You can also contact me through email and I can send all the information to you. Apart from lodging Form 13, you will also need a letter from me to provide to the Department of Immigration to get your fiance’s visa to come to Australia, leave it to me, I can write the letter as requested.
